When deciding to enter a construction investment, every Investor faces the problem of selecting a type of contract to conclude with the Contractor. A solution to any doubts related to the legal side and contents of such agreements is provided by the so-called FIDIC samples. The samples were designed by the International Federation of Consulting Engineers (FIDIC) for the purposes of international contracts, yet still they are often used in countries such as Poland where there are no local respected contract samples.
The parties in FIDIC contracts are: the ordering party (Investor) and the contractor.
Furthermore, the Contract Engineer is a key figure as this is the ordering party’s representative authorised to take action and make decisions of economic, organisational and technical type related to the course of the contract on behalf of the ordering party. Due to the scope of their responsibility, the Contract Engineer is usually an organisation of more than one person.
FIDIC Contract Engineer’s responsibilities include, among others:
- contract administration – investment management;
- technical and legal supervision on the construction site (Investment Supervising Inspector);
- contractor’s documentation control and verification.
Contract Engineer’s special tasks will include authenticating payments due to the Contractor in the course of works and preparing reports for the Investor. The Contract Engineer is responsible for construction progress according to the schedule, budget and contract concluded between the Ordering Party and the Contractor.
